Terms of Use

Please read these Terms of Use carefully before using Quarterdeck. By installing, accessing, or using the software, you agree to be bound by these terms. If you do not agree, do not use the software.

Section 01

About Quarterdeck

Quarterdeck is a vessel crew management software suite designed for use aboard professionally crewed vessels. It provides tools for Hours of Rest compliance, crew boarding and muster management, crew transport booking, safety drills, crew identification, and related operational functions.

Quarterdeck is developed and maintained as an independent product and is not affiliated with any flag state authority, port state control body, classification society, or regulatory agency.

Section 02

Licence

Subject to payment of the applicable licence fee and acceptance of these Terms, we grant you a non-exclusive, non-transferable licence to install and use Quarterdeck on a single vessel installation for the duration of the licence period.

Each licence is issued per vessel. Use of Quarterdeck on additional vessels requires a separate licence for each vessel.

You may not:

  • Sublicense, resell, or transfer the software or licence to any third party without prior written consent
  • Modify, reverse engineer, decompile, or create derivative works from Quarterdeck
  • Use Quarterdeck on more vessels than your licence permits
  • Remove or obscure any copyright, trademark, or proprietary notices

Section 03

Trial period

We may offer a free trial period of up to three (3) months. During the trial, all features of the selected tier are available at no charge. No payment details are required to begin a trial.

At the conclusion of the trial period, continued use of Quarterdeck requires purchase of a licence. If no licence is purchased, access will be suspended after a fourteen (14) day grace period.

Trial installations hosted on Quarterdeck infrastructure will be made available for migration to your own hosting or onboard installation at the end of the trial. You are responsible for arranging this migration. We will provide your complete data backup for this purpose.

Section 04

Hosting and data ownership

Quarterdeck is designed to be installed and operated locally aboard the vessel or on hosting infrastructure of your choosing. You own all data entered into your Quarterdeck installation.

Where a vessel uses temporary hosting provided by us during a trial period, this hosting is provided as a convenience only. At the conclusion of the trial:

  • A complete backup of your installation, including all data, will be provided to you
  • You are responsible for restoring this backup to your own hosting environment or onboard server
  • We do not retain copies of your data after the migration is complete

Backups, uptime, and data integrity for self-hosted or onboard installations are entirely your responsibility.

Section 05

Licence keys and renewal

Access to Quarterdeck components is controlled by licence keys issued per component or per vessel. Licence keys are issued upon purchase and delivered by email.

You are responsible for applying renewed licence keys before expiry. A grace period of fourteen (14) days is provided after a licence expires, during which the software remains operational. After the grace period, access may be suspended until a valid key is applied.

We will attempt to notify you by email in advance of licence expiry. It is your responsibility to ensure your contact email address is current and that renewal notices are received.

Section 06

Compliance responsibility

Quarterdeck is a tool to assist with maritime compliance tasks including Hours of Rest recording. However:

The Master, officers, and vessel operator remain solely responsible for ensuring compliance with all applicable regulations including MLC 2006, STCW, flag state requirements, and port state control obligations. Quarterdeck does not guarantee regulatory compliance and should not be used as the sole means of demonstrating compliance without verification by a qualified officer.

We make no representations that Quarterdeck satisfies the requirements of any specific flag state, classification society, or port state control authority. You should verify suitability with your DPA, flag state, or class society before relying on Quarterdeck for compliance purposes.

Section 07

Updates and support

We will issue updates to Quarterdeck components from time to time. Updates may include bug fixes, new features, or security patches. Updates are delivered as new component packages which you are responsible for installing.

Support is provided on a reasonable efforts basis by email. Response times are not guaranteed. We do not provide on-site support.

We reserve the right to discontinue support for older versions of Quarterdeck components where a newer version is available.

Section 08

Limitation of liability

To the fullest extent permitted by applicable law, Quarterdeck and its developer shall not be liable for:

  • Any loss of data, including crew records, Hours of Rest logs, or operational records, arising from hardware failure, software error, or user action
  • Any regulatory penalty, port state control detention, or flag state sanction arising from use or misuse of the software
  • Any indirect, incidental, consequential, or special damages arising out of or in connection with use of Quarterdeck
  • Any interruption to software availability, including during licence grace periods or hosting transitions

Our total liability to you in connection with Quarterdeck shall not exceed the licence fees paid by you in the twelve (12) months preceding the claim.

Section 09

Termination

You may terminate your licence at any time by ceasing use of the software and notifying us in writing. No refunds are provided for unused portions of a licence period.

We may suspend or terminate your licence if you breach these Terms and fail to remedy the breach within fourteen (14) days of written notice.

Upon termination, you must delete all copies of Quarterdeck from your systems. Your data, including crew records, remains yours and will not be deleted by us in any self-hosted installation.

Section 10

Governing law

These Terms are governed by the laws of Spain. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Tarragona, Spain, unless otherwise agreed in writing.

Nothing in these Terms affects any statutory rights you may have under applicable consumer or data protection law.

Section 11

Changes to these terms

We may update these Terms from time to time. Where changes are material, we will notify existing licence holders by email at least thirty (30) days before the changes take effect. Continued use of Quarterdeck after that date constitutes acceptance of the updated Terms.

The current version of these Terms is always available on our website.
